Terms and conditions of sale and use

1. Purpose

These terms and conditions govern the sale and use of the services offered by Delphea Blue on delpheablue.com. Placing an order implies full and unreserved acceptance of these terms, in the version in force on the day of the order.

They may be amended at any time. The version applicable to an order is the one published on the site at the time the order was placed.

2. The provider

Delphea Blue designs personalised travel itineraries in Greece, with particular attention to diving, freediving and local food.

3. Nature of the service — what Delphea Blue is not

Delphea Blue sells advisory and content creation: a digital document proposing an itinerary, addresses and recommendations. Nothing else.

Delphea Blue is not a travel agency and is neither a tour operator nor a travel retailer. Delphea Blue does not sell, book or collect payment for any transport, accommodation, rental or activity, and receives no commission on them.

Travellers make their own bookings and contract directly with the providers concerned, under each provider's own terms. Establishments mentioned are recommendations only, with no contractual link and no financial consideration, unless expressly stated otherwise.

4. Packages and prices

Three packages are offered: La Boussole (€25), L'Escale (€49) and Le Grand Bleu (€99). The exact contents of each are set out on the site's home page and form part of the contract.

Prices are shown in euros, all taxes included, and apply per itinerary rather than per traveller. The price is the same whichever region is chosen. Delphea Blue may change its prices at any time; the price applied is the one displayed at the time of the order.

5. Ordering and payment

An order starts with the contact form, in which the traveller describes their project: dates, duration, number of participants, diving level, wishes and constraints. Delphea Blue then confirms feasibility and terms by email.

The contract is formed upon receipt of full payment. Payment is made in a single instalment by card, Apple Pay or Google Pay, through the provider Stripe. No banking data passes through or is stored on Delphea Blue's servers.

Delphea Blue reserves the right to decline an order, in particular where the request falls outside its area of expertise, where the timescale is unrealistic, or in the event of a prior dispute with the customer. In such cases, any sums already paid are refunded in full.

6. Delivery

The itinerary is delivered as a PDF document, sent by email to the address given at the time of the order. The indicative lead time is five working days from payment and from receipt of all information needed for personalisation.

This lead time runs from the day the file is complete: a questionnaire returned late postpones it accordingly. Should it be significantly exceeded through Delphea Blue's own doing, the customer may request cancellation of the order and a full refund.

For the Le Grand Bleu package, the thirty-minute video call is scheduled by mutual agreement, in principle before the itinerary is finalised.

7. Adjustments

Delphea Blue reworks the delivered itinerary until it genuinely matches the traveller's project. Adjustments apply within the scope of the package ordered: they allow a stop, an address or a pace to be changed, not the service to be extended beyond what was purchased.

For the Le Grand Bleu package, adjustments are unlimited for thirty days from delivery. For the other packages, they are agreed case by case in good faith.

A complete change of destination, dates or duration after delivery constitutes a new order.

8. Right of withdrawal

In accordance with consumer law, a consumer is in principle entitled to a fourteen-day period in which to withdraw from a distance contract, without having to give reasons or bear any penalty.

However, this right does not apply to the supply of digital content not provided on a tangible medium where performance has begun with the consumer's prior express consent and express waiver of the right of withdrawal. As the itinerary falls into this category, that consent is obtained explicitly at the time of the order.

As long as work on the itinerary has not started, the order may be cancelled on request and refunded in full.

9. Liability

The information gathered in the itinerary is carefully checked as at the date it is written. It nonetheless remains subject to change: opening hours, prices, closing days, access, ferry connections and operating conditions change without notice, particularly out of season. It is the traveller's responsibility to confirm them before travelling.

The itinerary is a proposal and a set of recommendations. The traveller alone decides their route and alone bears responsibility for their choices on the ground. Delphea Blue cannot be held liable for the unavailability of an establishment, the quality of a service provided by a third party, a transport incident, a weather event, or any circumstance beyond its control.

In any event, and save in cases of gross negligence or wilful misconduct, Delphea Blue's liability is limited to the amount actually paid for the service concerned.

10. Diving, freediving and water activities

Delphea Blue does not organise, supervise or lead any dive, freediving session or water activity. Sites and dive centres are mentioned for information only.

Scuba diving and freediving carry inherent risks, including serious injury and death. Travellers undertake to dive only within the limits of their certification and medical fitness, to respect the prerogatives of their level, local regulations and the instructions of professionals on site, and to abandon any activity that the conditions of the day make unreasonable.

Any required level indicated for a site is general information and constitutes neither an assessment of fitness nor authorisation to dive. Only the supervising dive centre on site is in a position to judge. Freediving alone, without a safety buddy, is strongly advised against in all circumstances.

It is the traveller's responsibility to take out insurance covering these activities, as diving is frequently excluded by default.

11. Formalities and insurance

Travellers are solely responsible for the validity of their travel documents (identity card, passport, visa where applicable), their health cover and their insurance — cancellation, assistance, repatriation, civil liability and sports activities. Delphea Blue may give general guidance on this; it does not replace checking with the competent authorities and insurers.

12. Intellectual property

The delivered itinerary, texts, address selections, maps, photographs and all the site's content are protected by copyright and remain the property of Delphea Blue.

Customers are granted a strictly personal and private right of use, extending to those travelling with them. Any reproduction, public distribution, publication online, resale or commercial exploitation, even in part, is prohibited without prior written consent.

13. Personal data and cookies

Information submitted through the contact form — name, email address and description of the travel project — is collected for the sole purpose of answering the enquiry, designing the itinerary and following up the order. It is neither sold, rented nor transferred to third parties for commercial purposes.

Data is kept for as long as the business relationship requires, then for the statutory period applicable to accounting obligations. Technical providers strictly necessary to the service — hosting, email delivery, payment — may access it to that extent only.

Under the General Data Protection Regulation, everyone has a right of access, rectification, erasure, restriction, objection and portability, exercisable by email to contact@delpheablue.com. A complaint may be lodged with the competent supervisory authority.

The site sets no advertising cookies and carries out no profiling. Traffic is measured with Google Analytics 4, provided by Google Ireland Limited, for the sole purpose of knowing the number of visits and the pages viewed.

This measurement starts only after your consent, collected through a banner when you arrive. Until you accept, no Google script is loaded and no analytics cookie is set. Declining takes nothing away from the site, which works identically.

If you accept, the data collected — pages viewed, visit duration, referral source, device type, country — is kept for fourteen months, and the cookie set (_ga) for thirteen months at most. Google acts as a processor; data may be transferred outside the European Union under the European Commission's standard contractual clauses.

You may change your choice at any time through the “Analytics” link in the footer. A refusal is remembered for six months, an acceptance for thirteen; after that, the question is asked again. Local storage is also used, without any cookie, to remember your chosen display language and your answer to this banner.

14. Complaints and mediation

Any complaint should be sent to contact@delpheablue.com. Delphea Blue undertakes to reply as promptly as possible and to seek an amicable solution.

In accordance with consumer law, a consumer who is not satisfied may refer the matter free of charge to a consumer ombudsman. The European online dispute resolution platform is also available to consumers residing in the European Union.

15. Governing law

These terms are governed by French law. Failing an amicable settlement, any dispute falls to the competent French courts. Consumers retain the right to bring proceedings before the court of their place of residence.

Should any clause of these terms be held invalid, the remaining clauses shall continue to apply.

These terms are published in French and in English. In the event of any divergence of interpretation between the two versions, the French version prevails.
